Prescription Drug Refund Policy


(In accordance with TX Title 22, Chapter 291, Subchapter A, 22 TAC §291.8)

 

Purpose:
This policy outlines the circumstances under which prescription drugs may be refunded, replaced, or returned by our pharmacy. This policy is designed to comply with Texas State Pharmacy regulations and ensure the safety and quality of all medications dispensed.

 

  1. Prescription Errors:

In the event of a prescription error (such as dispensing the wrong medication, incorrect dosage, or a labeling mistake), the pharmacy will take the following actions:

  • Refund/Exchange: A full refund or exchange of the medication will be provided to the patient.
  • Notification: The patient must notify the pharmacy as soon as possible upon discovering the error. The pharmacy may request the return of the dispensed medication, and we will provide instructions for how to return the product safely.
  • Insurance Reimbursement: If applicable, insurance carriers will be contacted for reimbursement of the cost of the medication.
  1. Shipping Delays:

If a medication is delayed in shipping (e.g., via mail-order service or home delivery), and the delay impacts the timely receipt of the medication, we will take the following steps:

  • Refund/Reshipment: If the patient does not receive their prescription medication within the expected delivery timeframe and this delay is attributable to the pharmacy or shipping carrier, we will offer a full refund or reshipment of the medication at no additional charge.
  • Notification: The patient must contact the pharmacy within 24 hours of the expected delivery date to report the delay. The pharmacy will confirm the cause of the delay and take appropriate action.
  1. Other Instances:

In all other instances not covered by a prescription error or shipping delay, any request for a refund or return of prescription medications will be considered on a case-by-case basis in accordance with applicable Texas Pharmacy regulations (TX Title 22, Chapter 291, Subchapter A, 22 TAC §291.8).
No returns of prescription medications will be allowed except as outlined above. In compliance with 22 TAC §291.8, prescription medications cannot be re-dispensed once they have been removed from the pharmacy and are in the possession of the patient. This is to ensure the safety, integrity, and efficacy of all medications.

  1. Exceptions:

Exceptions to this policy may apply based on the following:

  • Manufacturer Recall: If the manufacturer issues a recall of a medication, the pharmacy will provide a full refund or replacement as per the recall instructions.
  • Expiring Medications: If a medication is dispensed close to its expiration date or the patient receives an expired medication, the pharmacy will offer a full refund or exchange.
  1. Regulatory Compliance:

This refund policy is in compliance with the Texas Administrative Code (TAC), Title 22, Chapter 291, Subchapter A, 22 TAC §291.8, which governs the operation of pharmacies and ensures the protection of public health and safety.
